HUNTSVILLE, Texas (AP) — A Texas appeals court has reversed a judge’s order to delay Thursday’s scheduled execution of a man who would become the first person in the U.S. to be put to death for a murder conviction tied to a diagnosis of shaken baby syndrome. The ruling by the Texas Court of Criminal Appeals was immediately appealed to the Texas Supreme Court as supporters of Robert Roberson sought to spare him after he was convicted in the 2002 death of his 2-year-old daughter. A judge earlier granted a temporary restraining order to delay Roberson’s planned lethal injection so he could testify before lawmakers about his case next week. Critics say Roberson’s conviction was based on faulty scientific evidence.
