Federal Appeals Court Blocks Texas’ Migrant Arrest Law Yet Again

A Federal Appeals Court has voted to put SB 4 on hold yet again.

This comes after the U.S. Supreme Court gave the okay to uphold the strict immigration law Tuesday.

SB 4 would allow Texas officers to arrest migrants accused of entering the U.S. illegally. Once defendants are in custody, they can agree to a judge’s order to leave the U.S. or face prosecution.

But just hours after the Supreme Court decided to put the law back into effect Tuesday, a 5th U.S. Circuit Court of Appeals panel temporarily put it on hold yet again.

It’s not clear when the next decision might be made either.

During the short time the law was in effect Tuesday, Texas authorities did not announce any arrests or say whether it was being actively enforced.
