Mansfield, TX (WBAP/KLIF) – A Mansfield daycare has been sued over its hiring practices and saftey protocols

The suit against the Everley Rose Infant and Toddler Learning Center located at 1745 N Walnut Creek Dr., and employee Caitlin Luttman of Waxahachie alleges that Luttman stabbed a toddler with a ballpoint pen, according to the Fort Worth Star-Telegram.

Aaron and Carlie Walker claim that it happened to their 3-year-old son and that it was never reported and that the staff did not tend to the wound.

A lawyer for the daycare says the word “stabbing” is “incredibly overblown; Attorney Susan McCleland ,” and says that if their were any injuries they were minor.

The lawsuit says that the child told his parents he did not want to return to school and began to bite himself, and has suffered post-traumatic stress after being stabbed.

Jason Smith, one of the lawyers representing the Walker said,“The Walkers are filing this lawsuit to send a message loud and clear, that day cares have to do everything in their capacity to make sure children are safe. Everley Rose failed to do that with the child.”

The child “felt so unsafe because of the assault … that he has acted out toward his mother,” according to the lawsuit.

Luttman was arrested in April and later indicted in September on the charge of “injury to a child and reckless bodily injury,” in the ongoing criminal case.
